Inside The Industry: Consumers Demand Honesty in Gas Price Signage
By the time duped drivers figure it out, most grin and bear it and move on. But, not everyone: As of last week, 234 consumers had filed complaints this year with the Florida Department of Agriculture and Consumer Services about gas station pricing, many upset over the difference in publicized prices and receipt totals. Such grievances are spurring Palm Beach County commissioners to consider an ordinance that would demand truth in advertising on gas station signs. It is pretty clear that gas station owners and managers know exactly what they are doing when they tout low prices in giant numbers on roadside signs, absent an asterisk that says the prices are for cash purchases, not those made on credit cards. Because credit card companies charge for each swipe, gas station owners operating on slim margins say they lose profit on credit card purchases. But their problem is with the credit card company, not the consumer who relies on roadside signs to pick the best price, then gets duped by a signage sleight-of-hand.
Broward County commissioners tackled the problem last year, passing an ordinance that requires gas stations to post the highest prices per-grade advertised, no matter how someone pays for the fuel. The county ordinance carries a big stick, a $250 fine for a first violation and $500 for repeat violations. In Miami-Dade County, gas signs may tout the minimum price, but must include the condition of the sale, cash versus credit. Palm Beach County now stands poised to shore up protections for all South Floridians.
When it comes to consumer protections for an essential commodity, Florida should set one statewide standard. The Florida Legislature has shown some interest, but little action. Bills similar to Broward’s ordinance were considered in committees last year. A House analysis found price discrepancies could vary five to 14 cents per gallon at Florida’s 9,025 gas stations, for consumers who paid with cash rather than a plastic card.
